ACCOMMODATION OF DISABLED EMPLOYEES

Article 85

Section 1

For the purpose of this Article, a disabled employee is a medically qualified employee whose permanent disability renders him/her unable to perform his/her duties at his/her present facility.

Section 2

A disabled employee shall receive priority consideration at his/her request to any facility with an existing vacancy at which the employee's disability does not preclude him/her from performing such duties.

Section 3

Nothing in this Article is intended to limit the applicability of the Rehabilitation Act of 1973, as amended, including the employee's right to reasonable accommodation.
